Terms and Conditions

1. Scope of Services

Detailed Description: The specific services to be provided (fertilizer, weed control, fungicide, insecticide, new planting, etc.) will be outlined in a separate Service Agreement or invoice.

Exclusions: Services not explicitly listed (e.g., watering, trash removal) are not included. The client is responsible for removing all obstacles (furniture, toys, pet waste, etc.) from the service area before each visit.

2. Service Schedule and Access

Frequency and Duration: Services may be scheduled on a recurring basis (e.g., seasonal, annual, or as needed) as specified in the service agreement. Services may be performed on the scheduled date, weather permitting, but an exact time cannot be guaranteed due to uncontrollable conditions.

Property Access: The client must provide clear and unobstructed access to the property during scheduled service hours. Gates and access points must be unlocked. If access is not available, the service may be rescheduled, and a service fee might be charged.

Pets and Safety: For the safety of our team and your pets, all pets must be secured indoors during service visits. The client is also responsible for ensuring children or visitors are safe and away from the work area during service.

3. Pricing and Payment Terms

Fees: The client agrees to pay the specified fees for services rendered as detailed in the invoice or service agreement.

Payment Due Date: Payments are due upon receipt of invoice or within 30 days of invoice date.

Late Fees: A late fee of $30 will be assessed on all accounts 30 days overdue. A service interruption will occur on all accounts 60 days overdue. Service will be restored once all account balances are paid.

Payment Methods: We accept various payment methods, which will be specified on the invoice. A service charge may apply for returned checks.

Price Increases: The company reserves the right to increase service prices due to increases in labor, materials, fuel costs, or other unforeseen circumstances, with at least 30 days' advance written notice. Clients have the right to terminate services within the notice period if they do not agree to the new price.

4. Liability and Warranty

Limitation of Liability: Our company is not liable for indirect, incidental, or consequential damages. We are not responsible for damage to underground utilities (e.g., irrigation lines, invisible fences, cables) not properly marked or disclosed by the client.

Damage Claims: Any property damage must be reported to the company in writing within 48 hours of service completion. The company will, at its discretion, inspect the damage and determine whether to repair, replace, or provide a partial refund. The company is not liable for items carelessly left in the service area.

Service Warranty: We stand by the quality of our work. If you are not satisfied with a service, you must notify us within a reasonable time frame (e.g., 48-72 hours) after completion, and we will address the issue at no additional cost.

5. Licensing and Compliance

Professional Standards: All chemical applications (fertilizer, weed control, fungicide, insecticide) will be performed by trained, licensed professionals in compliance with all applicable local, state, and federal laws and regulations, including those set by the EPA and the North Carolina Department of Agriculture.

6. Termination of Services

Cancellation by Client: The client may cancel or terminate future services at any time by providing advance written notice (e.g., 30 days).

Cancellation by Company: We reserve the right to suspend or terminate services if payment terms are consistently violated or for any other reason, with appropriate notice.

7. Governing Law and Dispute Resolution

Governing Law: These terms and the service agreement are governed by the laws of the State of North Carolina.

Dispute Resolution: In the event of a dispute, both parties agree to attempt to resolve the matter through good-faith negotiation, potentially including mediation, before pursuing legal action.
